The following terms and conditions were created in 2011 - 2019 by Playbet and are considered Playbet’s intellectual property as company financial resources, expertise and time were allocated during the process. Please do not copy parts of our terms and conditions as whole as it will be considered copyright infringement as Playbet will be entitled to damage claims as per South African copyright laws.


GENERAL

-IMPORTANT NOTICE In order to dispel any confusion in Playbet’s existing terms and conditions and also to ensure that Playbet’s terms and conditions are user friendly and easily understood by our clients Playbet has re-drafted its terms and conditions which will regulate all Playbet’s betting transactions with its customers effective from 1st November 2015 (last edited July 2019).

All our customers are requested to familiarize themselves with these terms and conditions and should you not accept these terms and conditions that regulate all betting transaction, Playbet’s customers should not engage in future betting transactions with Playbet. -INTRODUCTION Please note headings and numbering are for the purposes of convenience and reference only and thus shall not aid in the interpretation of or modify the provisions of these terms and conditions Words importing any one gender shall include the other genders and singular words shall include the plural. This terms and conditions shall apply also to all telephone betting and betting on mobile devices. References to use of the website shall also include telephone and mobile use unless the context clearly otherwise indicates.

Playbet’s failure, delays or neglect to enforce any of its rights under the terms and conditions will not be deemed to be a waiver of that or any other of its rights. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

By conducting an internet betting account (hereinafter referred to as “Account”) with Playbet and each time that you (hereinafter referred to as the “Customer”)transact a betting transaction with Playbet the Customer agrees to be bound by Playbet’s current terms and conditions, services and rules effective from the 1st November 2015 (and any subsequent amendments thereto) which are indicated hereinbelow i.e. if the Customer does not agree to all of Playbet’s terms and conditions, service and rules the Customer should not transact any betting transactions with Playbet.

PART 1: GENERAL TERMS AND CONDITIONS

1. ELECTRONIC AGENT AND THE RELEVANCE OF THE ELECTRONIC COMMUNICATIONS TRANSACTIONS ACT OF 2002 (“THE ECT ACT”)

1.1 The Customer’s attention is drawn to the fact that internet betting transactions are made possible as a result of Playbet’s use of a computer programme and, in terms of the ECT Act, this is known as Playbet’s Electronic Agent (hereinafter referred to as the “Agent”).

1.2 The Customer acknowledges that it is possible that the Agent in concluding betting transactions with him/her may not always give effect to these terms, conditions and rules and accordingly Playbet will be entitled to cancel and/or amend betting transactions should the Agent permit betting transactions which are either prohibited and/or contravene Playbet’s terms, conditions and/or rules.

1.3 Playbet’s internet and mobile services are licensed by the Gauteng Gambling Board. The Gauteng Gambling Board’s rules and regulations can be viewed at www.ggb.org.za.

1.4 The customer acknowledges that he/she shall be solely responsible for the secrecy of his/her betting account and should make every effort to prevent the usage of his/her personal account by any third party. Any betting transactions entered into, where the Customer’s Account number has been unlawfully used to affect a betting transaction then the betting transaction will be of legal force; and

1.5 In the event that he/she suspects that a third party may have obtained his/her password or username, then he/she may at anytime request Playbet to furnish him/her with a new password and username; and

1.6 Playbet, without giving any reasons therefor, shall be entitled to terminate a Customer’s Account and in which event all future betting transactions shall be voided immediately and the credit of such Account shall thereafter be transmitted by Playbet to the Customer’s registered banking account.

1.7 Playbet reserves the right to terminate any account that does not comply with the T’s and C’s, the gambling laws and FIC Act without notice. Outstanding balances will be refunded to your registered bank account.

2. AGE RESTRICTIONS

2.1 The minimum age to opening an account with Playbet is 18 years.

2.2 The Customer acknowledges that he/she may not transact betting transactions with Playbet unless he/she is at least 18 years of age.

2.3 Should Playbet determine that the Customer is younger than 18 years of age or should a third party conduct an account with Playbet on behalf of a person who is under 18 years of age then Playbet shall void all betting transactions and terminate the account and to report you to the Gambling Board.

3. FICA

The Financial Intelligence Centre Act, 38 of 2001 (herein referred to as FICA.

Customer Verification and Due Diligence 3.1 Please note Bookmakers and totalisators are listed as accountable institutions under item 9 of Schedule 1 of the FIC Act.

3.2 Playbet and its subsidiaries must therefore comply with the relevant provisions of the FIC Act and the Money Laundering and Terrorist Financing Control Regulations (the Regulations).

3.3 The establishment of online betting account by a prospective client with Playbet is considered to be the establishment of a business relationship between that client and Playbet.

3.4 Therefore, in relationship with all online betting a client’s identity must be established and verified in the course of conducting a single transaction or entering into a business relationship.

3.5 This means that Playbet may initiate the process related to the conclusion of a single transaction or entering into a business relationship while it is verifying the relevant persons’ identities, but Playbet must complete the verification before concluding a transaction in the course of the resultant business relationship or performs any act to give to the resultant single transaction. 3.6 Accordingly, you are requested to provide documentary evidence of your identity and residence upon opening or establishing a business relationship with Playbet or before requesting any payout.

3.7 To establish and verify the identity of the client, the following are regarded as acceptable Identity documents:

i) An original RSA identity document book or smart card or; ii) South African Valid Passport or; iii) South African driver’s license (card format) and;

3.8 Identity documents for foreign nationals i) Valid passport showing the client is legally in the republic. ii) Valid refugee/asylum certificate

3.9 Accepted proof of address i) A utility bill or bank statement showing the client’s name and physical address (please note not older than 3 months) or; ii) Lease agreement iii) Bond statement iv) Official tax return v) Letter from the traditional authority, the letter must confirm that the individual is permitted to reside on communal land, and must be signed and stamped by the traditional authority

3.10. In the event a client fails to comply with the FICA provisions then Playbet shall be prohibited from paying any credit balance in the customer’s account.

4. DEPOSITS INTO PLAYBET BANKING ACCOUNTS

4.10. Deposits from account holders can be made via various platforms set out hereunder. Customer’s account will only be credited once the amount has been cleared. Playbet may request proof of payment. All deposit must reflect the customer’s betting account as reference.

4.11. Should the Customer fail to indicate its reference as the account number and/or incorrect reference number then Playbet shall not be liable for any damages that the Customer may suffer as a result of this fact.

4.12. Should an event commence before the deposit is cleared, Playbet will not be held liable for any bets missed as a result thereof.

4.16. Credit Card Deposit

Please note if you use a credit card to deposit into your betting account all winnings or credit balance shall be transferred to the credit card used. Playbet may request further documentation. All card transactions are 3D secure.

4.17. Direct Bank Deposits

Please note Direct Bank (or EFT) Deposits can take up to 72 hours to reflect with your account. Please make sure you use your Playbet account ID as a reference.

5. WITHDRAWALS

5.10. At all times the customer must ensure their details are also kept up to date as Playbet will not be held liable to any loss or damage as a result of information not updated.

5.11. At any point of the withdrawal process or at any potentially suspicious activity you may be requested to provide us with additional documentation proving your identity and address to our satisfaction, failing which we may suspend or close your account immediately.

5.12. Acceptance of withdrawal request is subject to you having made and sufficiently wagered a real-money deposit.

5.13. All amounts you withdraw are subject to the transaction limits.

5.14. Customers who have not submitted their identity documents and proof of residence as per FICA requirements are requested to do so before any withdrawal can be processed.

5.15. Any credit balances in the Customer’s account will be settled only in South African Rands.

5.16. You agree that Playbet shall only be obliged to give effect to your instruction by depositing the amount requested into a bank account designated in your name, and held with a banking institution registered and operating in South Africa.

5.17. Cash withdrawals i) Cash withdrawals can be made at either two of our branches namely Pretoria branch and/or Malvern branch. ii) Clients will be asked to present their identity documents for all cash withdrawals request.

6. BETTING TAX

All winning horse racing contingencies shall be subjected to a 6% (six per cent) betting tax in accordance with the relevant gambling laws. This shall also apply to multiple bets in which a horse racing event is selected.

7. PROHIBITION AGAINST SYNDICATE BETTING

7.10. The customer affirms not to take part in any syndicate betting for the purposes of evading these terms and conditions or exceeding the payout limits as set out in Part 3 of the betting limits 7.11. In the event that a number of betting transactions containing the same selections and/or similar selections are transacted with Playbet by more than one of its customers and Playbet has reason to believe that these betting transactions originate from or have been transacted on behalf of the same customers or a syndicate of customers; 7.12. Playbet reserves the right to limit the total winnings payable in respect of all betting transactions i.e. to treat them as constituting one betting transaction and then applying the limits indicated in Part 3 of the betting limits.

8. INTERNET BETTING TERMS AND CONDITIONS

PLAYBET’S RIGHT TO RESTRICT A CUSTOMER’S BETTING TRANSACTIONS<b>

The customer acknowledges that:

8.10. Customers may open only one account. Should we identify any customer with more than one account we reserve the right to close such accounts.

8.11. You must ensure that the details provided when opening an account (including but not limited to your address meaning your usual place of residence, telephone number and email address) are accurate and kept up to date. You can access and amend your own individual account information on the Website (including via your mobile or tablet device),

8.12. Playbet, in its sole and unfettered discretion, shall be entitled to refuse and/or to limit and amount to be staked by a customer on his/her Account even if there are sufficient credit amounts in the Account which permit the Customer to transact a greater amount relative to a specific betting transactionthereby.

8.13. all successful betting transaction amounts will only be credited to the Customer’s account and no amount will be transferable from one Customer’s Account to another Customer’s Account; and

8.14. that the minimum amount to be withdrawn from the Account by a Customer that is an overseas Customer is the sum of R1 000 (One Thousand South African Rand);and

8.15. account balances will be the sole responsibility of the Customer and should be checked at every available opportunity; and

8.16. the customer’s attention is drawn to the fact that internet betting transactions are made possible as a result of Playbet’s use of a computer programme.

8.17. It may happen that due to error by its electronic agent, human error or unlawful conduct by an employee and or a wrong result entered which gives raise to an incorrect credit being reflected on your account;

8.18. in the event that funds are credited to his/her Account in error, it will be incumbent upon him/her to notify Playbet of the aforesaid error without delay. In the event that the Customer should utilize a credit amount erroneously credited to his Account then Playbet shall be entitled to void all successful betting transactions arising from the unlawful use of credit amount/s; and

8.19. in the event that the reversal of the credit amounts results in the Account reflecting a debit balance, the customer undertakes to effect payment within 48 hours in order to correct the debit balance;

9. PLAYBET’S RIGHT TO CORRECT ERRORS INCLUDING BETTING TRANSACTIONS ARISING FROM THE FAILURE OF ITS COMPUTER SYSTEM “THE AGENT” (HARDWARE AND/OR SOFTWARE) AND HUMAN ERRORAND/OR FRAUD

9.10. Whilst Playbet endeavours to prevent and eliminate any errors during the course of betting transaction, however errors may occur attributable to but not limited to:

i) malfunction of computer software; ii) human error iii) unlawful conduct arising in the nature of hacking into the Computer system iv) unlawfully typing incorrect betting odds

9.11. The Customer acknowledges that Playbet shall at any time be entitled to cancel and/or amend betting transactions in the event that the Agent should permit betting transactions that are either prohibited and/or contravene Playbet’s terms, conditions and/or rules and more particularly but not limited to after the sporting event concerned has been completed.

9.12. The Customer acknowledges that Playbet shall have the right to amend betting transactions which exceeds the limitsin order to bring same within the win limit impositions.

9.13. Customer acknowledges that Playbet reserves the right to correct errors in relation to betting prices also known as odds regardless of whether a bet has been taken or not.

9.14. The customer acknowledges that Playbet reserves the right to correct any errors in odds offered at any time by substituting the corrected odds as determined by Playbet, in its sole discretion in respect of the event concerned, for the original price, regardless of whether or not the bet has been struck, in which event you will be deemed to have been offered and where applicable, accepted and accordingly the bet to have been struck at the corrected odds.

9.15. In the event that the customer disputes the correctness of the betting odds that Playbet applies then the onus will on the customer to provide facts and evidence of generally greater betting odds than that applied by Playbet.

9.16. The Gauteng gambling board has upheld that bookmakers may, in compliance with its terms and conditions void or amend bets which were erroneously accepted against its terms and conditions.

10. PROHIBITION AGAINST CANCELLING AND/OR AMENDING BETTING TRANSACTIONS

10.10. The customer acknowledges that once a betting has been offered and thereafter accepted by Playbet then the Customer may not cancel and or seek to amend same.

10.11. Playbet may incorrectly reflect any error as regards to sport event, venue, time, date, team composition identity of any competitor due to human error, and/or as a consequence of the malfunction of its Computer system, and or unlawful and prohibited acts of third parties and/or employees of Playbet.

10.12. In the event that Playbet incorrectly reflects information as regards to point 10.2, customers shall not be entitled to cancel or void the bet concerned. Furthermore, customers shall not be entitled to any refund of stakes.

10.13. The onus is on the customer to determine the correctness of all the information in regards to the sporting event under concerned.

10.14. Playbet shall not be liable to any damages that the customer may allege to have suffered as a consequence of any incorrect information displayed on its website.

11. PLAYBET’S ERRORS AND/OR OMISSIONS RELATING TO “IN PLAY” OR “IN RUNNING” EVENTS

11.10. “IN PLAY” also known as Live in Play betting refers to all bets that take place while an event is in progress, but before the event has ended. The odds in respect thereof shall be continuously updated during the event to reflect the current status of the game.

11.11. Playbet reserves the right to open and suspend in-running betting.

11.12. No bets shall be accepted when the betting is suspended.

11.13. The customer acknowledges that Playbet in its sole discretion shall be entitled to amend odds and avoid any bet if that bet was placed during a period when betting should have been suspended.

11.14. The computer system and or electronic agent may fail/malfunction and/or there may exist an error attributable to human error or unlawful conduct arising in the nature of hacking or unlawfully tying incorrect betting odds into the Computer system during the “in play”.

11.15. The customer acknowledges that Playbet shall be entitled to change any Transactions by cancelling the existing transaction and replacing same with an updated transaction reflecting the correct betting odds.

11.16. The win limit in respect of any In Running Bet shall be R30 000.00 for a single bet and R200 000 for multiple bets, and always subject to the maximum overall daily win limit (see win limits).

11.17. Playbet, in its sole and unfettered discretion, shall be entitled to impose a further win limit amount on specific Customers’ account.

11.18. The Customer agrees and understand that each sporting event has its own rules, which rules determine whether the specific sporting event results in an outcome and more particularly an outcome which may result in the success of a particular transaction.

11.19. The Customer acknowledges that all betting transactions shall be subject to individual sporting events rules, which rules are available for viewing on Playbet’s website at address www.playbet.co.za/pages/betting-rules

12. PLAYBET’S ERRORS AND/OR OMISSIONS GIVING RISE TO DAMAGES CLAIMS BY THE CUSTOMER

12.10. The customer acknowledges that Playbet shall in no way and under no circumstances, be liable for any damages or losses, including without limitation, direct or indirect, consequential or special incidental, even punitive damages deemed or alleged to have resulted from or arising from any information and/or data on Playbet’s website and or its content, including without limitation any persons usage or misuse of its content.

12.11. Although Playbet will endeavour to convey correct information as regards sporting events on its website (including dividends) the Customer acknowledges that Playbet shall not be liable for any errors and/or omissions arising from the dissemination of incorrect information data.

12.12. The Customer acknowledges that any Playbet faxes, emails, website and or any communication branding will not entitle the Customer from holding Playbet liable for any form of damages and/or liability arising from the inaccuracy of any information, whether it be in numerical, text or graphical form, presented on our website or by any other forms, including but not limited to any information relating to sports or race fixtures, locations, odds, times or results (“the information”.)

12.13. Playbet further accepts no responsibility for any information by any person. Playbet does not accept any liability for any losses incurred or damages suffered (including economic or consequential losses) either directly or indirectly and as a consequence of information displayed incorrectly and or otherwise made available on Playbet’s website and/or any information and/or communication supplied – this shall include any losses or damages sustained by the Customer and arising from any negligence on the part of/on behalf of Playbet, its employees, agents and /or consultants.

12.14. The customer acknowledges that Playbet shall in no way and under no circumstances, be responsible for content generated from third parties. Playbet shall not be liable for any damages or losses, including without limitation, direct or indirect, consequential or special incidental, even punitive damages deemed or alleged to have resulted from or arising from any third-party information and/or data on Playbet’s website and or its content, including without limitation any person’s usage or misuse of its content.

13. MINIMUM BETTING STAKE AND APPLICABLE CURRENCY

The Customer acknowledges that: -

13.10. all betting transactions shall only be transacted in ZAR (South African Rand); and

13.11. all successful betting transactions shall only be paid in ZAR; and

13.12. the minimum stake per betting transaction shall be ZAR 1.00.

14. SPECIFIC RULES GOVERNING SPORTS EVENTS

14.10. The Customer agrees and understand that each sporting event has its own rules, which rules determine whether the specific sporting event results in an outcome and more particularly an outcome which may result in the success of a particular transaction.

14.11. The Customer acknowledges that all betting transactions shall be subject to individual sporting events rules, which rules are available for viewing on Playbet’s website at address www.playbet.co.za/pages/betting-rules

14.12. The Customer acknowledges that there aredifferent sporting rules and regulations for each of our different sporting contingencies. The rules governing how markets offered, managed and/ or settled are not the same for every market on each product.

15. MULTIPLE BETS AND RELATED BETS.

15.10. The Customer shall be entitled to transact with Playbet multiple betting transactions but subject to the following conditions:

15.11. The Customer acknowledges that he/she will not be entitled to transact multiple betting transactions with Playbet where the outcome of one of the betting Multiple contributes to the outcome of another i.e. should a Customer inadvertently or deliberately transacts a betting transaction which is a related contingency in a multiple betting transactions and the odds applicable shall be those that existed (offered by Playbet) at the date and time that the betting transaction was transacted.

15.12. Multiple bets will be subject to the daily win limit. Where the selection of multiple bets is made from different contingencies, the lowest daily maximum winnings shall apply.

15.13. In the event that the Electronic Agent permits a prohibited multiple bet for any reason the money staked on that part of the bet which is void shall be placed on the remaining selections which comprise the multiple bet and the remaining selections of the bet shall stand.

15.14. Playbet reserves the right to determine which bets are related to each other. A related bet or contingency is when you combine the same selection from different events in the same multiple bet, or adding selections that have a direct effect on the outcome of the other.

16. VOIDING OF BETTING TRANSACTIONS WHERE THE SPORTING EVENT HAS ALREADY COMMENCED AND/OR HAS BEEN FINALIZED

Playbet shall be entitled, in its sole discretion, at any time to cancel Transaction/s under the following circumstances:

16.10. Unless an event is being covered by Playbet’s Live In-Running service, betting transactions transacted after the commencement of the relative sporting event will be voided at Playbet’s sole and unfettered discretion.

16.11. In the event that betting transactions relate to sporting events where the correct score and/or the first goal/points arise have been transacted after the GMT kick off time then Playbet in its sole and unfettered discretion shall be entitled to void the betting transaction.

16.12. In the event that the computer system fails to suspend betting during a period that betting should have been suspended, thereby allowing he Customer to place a bet then Playbet in its sole and unfettered discretion shall be entitled to void the betting transaction.

17. POSTPONEMENT OF SPORTING EVENTS AND/OR OTHER MATERIAL CHANGES

17.10. For all sports events unless clearly stated, sports events which commence and thereafter are postponed alternatively do not take place and thereafter are rescheduled to take place more than 48 hours after the original start time will automatically result in betting transactions being voided and all staked amounts be credited back to the Customer’s Account.

17.11. In the event that a sporting event is voided and the sporting event is included in a multiple bet, that betting transaction on the voided sporting event shall be treated as a “non-runner” and the outcome of the multiple will be decided on the result of the remaining betting transactions.

17.12. In the event that a sporting event is not completed within the full time anticipated then all betting transactions shall be voided.

17.13. In the event that a sporting event is a horse race event and the surface is changed (from that carded) or the race track is changed (from that carded) all betting transactions shall automatically be voided.

18. CARRYOVERS

18.10. In the event there be a carryover, i.e., a Customer places a Tote bet with Playbet and there be no winner in respect of the pool of the Totalisator, Playbet will pay a dividend determined by dividing the pool by the number of customers who have placed winning bets with Playbet. Maximum liability, in totality, to customers shall be limited to the total amount in the pool, and always subject to the overall daily win limit.

18.11. Where a partial carryover is declared by the Tote on an open bet, on non-commingled pools, Playbet shall pay its winning customers based on the value of the total pool. Maximum liability shall be limited to the total pool. These dividends and payouts will be subject to the overall daily win limit.

18.12. Where a partial carryover is declared by the South African Tote on open bet on commingled pools on international races, Playbet shall pay the dividend declared by Tote in respect of any winning bets placed.

18.13. The Customer acknowledges that all Tote/open bet transactions shall always be subject to the Tote limits and the daily payout limits.

19. DEAD HEATS

19.10. In a DEAD HEAT the stake money on a selection is divided by the number of runners or competitors involved in the dead heat.

19.11. The full odds are then paid to the divided stake, with the remainder of the stake money being lost.

19.12. If not otherwise stated, this rule applies for all cases where two or more betting options are deemed to be winning options.

20. SPORTING EVENT RESULTS

20.10. The Customer acknowledges that all betting transactions shall be subject to individual sporting events rules, which rules are available for viewing on Playbet’s website at address www.playbet.co.za/pages/betting-rules

20.11. Betting transactions transacted on sporting events will be determined with reference to the official results posted (in the case of horse racing events the giving of the “all clear”) at the end of the sporting event concerned i.e. subsequent changes to the official posted result shall not affect the result as official posted.

20.12. The Customer agrees and understand that each sporting event has its own rules, which rules determine whether the specific sporting event results in an outcome and more particularly an outcome which may result in the success of a particular transaction.

21. SPORT EVENTS WHICH ARE NOT COMPLETED WITHIN THE SPECIFIED TIME OF THE SPORTING EVENT

21.10. All betting transactions (specifically soccer and rugby games) are transacted on the basis that the result is constituted by the result at the end of full time. Accordingly, extra time and “penalty shoot outs” and the results thereafter shall not be taken into account unless the betting transaction is concluded on the specific basis that it contemplates the result at the end of the sporting event concerned (including extra time and/or at the end of penalty shootouts).

21.11. The Customer agrees and understand that each sporting event has its own rules, which rules determine whether the specific sporting event results in an outcome and more particularly an outcome which may result in the success of a particular transaction.

22. MATCH AND/OR SPECIFIC EVENT FIXING

22.10. in the event that Playbet should suspect that a specific sporting event and/ or an event within a sporting event has been manipulated (hereinafter referred to as “Match Fixing”) then it shall be entitled to delay payment of successful betting transactions which related to the Match Fixing sporting event and/or a specific betting transaction within a sporting event.

22.11. Playbet shall be entitled to delay the payment of successful betting transactions arising from the Match Fixing sporting indicated in condition 21.1 for a period not exceeding 6 months or for such later period if the sporting event and/or the event within sporting event is the subject matter of continued investigations by the relevant sporting authority and/or gambling authority.

22.12. In the event that the relevant sporting authority and/or gambling authority determine the existence of Match Fixing then the betting transaction concerned shall be void and the stake shall be refunded.

22.13. In the event that Playbet should determine, as a result of its own investigations and/or the investigations undertake by third parties, that Match Fixing has taken place it shall be entitled, in its sole and unfettered discretion, to void the betting transaction/s concerned and arising therefrom the amount staked shall be refunded.

23. RESOLUTION OF DISPUTES AND REFERRAL OF DISPUTES TO THE GAUTENG GAMBLING BOARD (“THE BOARD”)

23.10. The resolution of disputes between Playbet and its Customers is governed by Playbet’s terms and conditions, as well as the Gauteng Gambling Act no. 4 of 1995.

23.11. In the event that a Customer disputes any conduct of Playbet relating to a betting transaction then the Customer undertakes to lodge a complaint in writing with Playbet at its offices at 546 Jules Street, Malvern Johannesburg within 10 (ten) working days from the date of the betting transaction in question.

23.12. Playbet shall have a period of 10 (ten) working days from the lodgement of the dispute by the Customer to consider same and possibly to reverse the decision contemplated in condition 21.2.

23.13. Should Playbet refuse to reverse its decision contemplated in condition 21.2 or respond to the Customer’s dispute within the time period indicated in condition 21.3 the Customer shall be obliged to refer the dispute to mediation, in order that an attempt be made to resolve the dispute before the mediator indicated in condition.

23.14. The mediator contemplated in condition 21.4 shall be the chairperson or any person designated by him of the Gauteng Off-Course Bookmakers Association.

23.15. The Chairperson, or his designate, shall be entitled to determine the manner, place and the form of the mediation including but not limited to, the compelling of the Customer to answer questions and/or to provide documents at the hearing, including affording any representative of Playbet an opportunity to question the Customer at the mediation hearing.

23.16. The Customer undertakes to comply with all the reasonable demands of the person chairing the mediation hearing and furthermore agrees that until the mediation hearing has been finalized, and he/she has fully complied with the rulings and/or directions thereat, he shall be precluded from lodging any complaint with the CEO of the Gauteng Gambling Board in terms of Regulation 24 of the Gauteng Gambling Act.

23.17. If the Customer is not happy with any ruling, then you may refer the dispute to the CEO of the Gauteng Gambling Board.

24. TELEPHONE BETTING

24.10. Playbet’s internet terms and conditions shall also apply to any transaction conducted through the medium of a telephone.

24.11. It is the Customer’s responsibility to ensure that the details of all bets are correct when called to and confirmed by the operator.

24.12. Once the bet has been confirmed by the operator and agreed to by the client, it will be deemed as being the correct offer being made by the client.

25. ANTE POST BETTING (FUTURE EVENTS):

25.10. Ante post prices are those offered on:

25.10.1. Horse Racing prior to the final declaration stage.

25.10.2. Sports events prior to the start of an event. When stakes are refunded on a competitor who withdraws from an event a rule 4 deduction may apply to winning bets.

25.10.3. All special (non-sporting) events.

25.11. Ante-post Horse racing bets are accepted on the understanding that you will lose your stake if your selection does not participate.

25.12. Bets placed after the start of a sports event are not classified by us as ante post. Unless a specific reference is made in the rules for a particular sport, the start of an event is defined as the first time there is any competitive action. Stakes will be refunded on competitors/teams who take no further part after the bet is placed, unless they have been eliminated by competition rules.

25.13. Stakes are lost on competitors/teams who start an event and then withdraw.

25.14. In total tournament/series markets e.g. top series wicket taker, winner of the golden boot etc. individuals named in the team squad will be deemed to have participated whether or not they have taken part in any competitive action.

25.15. Ante post each way doubles, trebles etc. are settled win to win, place to place.

25.16. Ante post bets are settled at the price and place terms applicable at the time of acceptance.

25.17. Where the same selection is backed to win two or more ante post events in an accumulative bet a special combined price will apply irrespective of any individual prices quoted.

25.18. In these events the multiple bet will be reduced by one-third of the full accumulated odds.

25.19. Bonuses and consolations associated with any bet type are not available at ante post odds. If taken in error bets will be settled without the bonuses or consolations.

25.20. If a horse race is cancelled, rescheduled to run at another racecourse or run on a different surface (turf to all weather or vice versa) then ante post bets will be made void.

25.21. If an ante post horse race is postponed to another day: Ante post bets placed before the entries have closed will stand and will only be made void if- 25.24.1 The race is abandoned or made void. 25.24.2 A horse is balloted out under the rules of racing. 25.24.3 The venue is altered. Ante post bets placed after the entries have closed will be void.

26. TERMINATION OR SUSPENSION OF ACCOUNT

26.10. Playbet reserves the right to suspend and/or terminate betting services to a customer without providing any reason and thereby suspend and/or terminate the Customer’s ability to transact any future transactions.

26.11. Playbet shall be entitled to cancel any current and future transactions.

26.12. Without limiting the provisions on 26.1, Playbet, in its absolute discretion shall be entitled to suspend and/or terminate Customer’s account in the event the following occurred or deem that a good cause exists to do so:

26.12.1.1. that the Customer has fraudulently and/or unlawfully used Playbet’s facilities.

26.12.1.2. The Customer is in breach of these Terms and Conditions.

27. WAIVING The Customer agrees that Playbet shall be entitled to exercise all of its rights arising from its terms, conditions, services and rules at any time and that the Customer shall not be entitled to contend that Playbet, by not exercising any rights timeously, has waived any of its rights.
28. LEGAL USE OF THE WEBSITE

28.10. Access to or use of the Website or any of the Services via the Website may not be legal for some or all residents of or persons in certain countries. We do not intend that the Website should be used for betting, gaming or any other purposes by persons in countries in which such activities are illegal.

28.11. 29.11. The Customer acknowledges that he/she shall not be able to assert (whether unilaterally or by reason of written and/or oral communications of whatsoever nature) that these terms, conditions, services and/or rules have been amended and/or cancelled unless such amendments (including additions and/or cancellations hereto) are reduced to writing and signed by the Customer and a director of Playbet with the approval of the Gauteng Gambling Board.

PART 3: BETTING TRANSACTION WIN LIMITS

1. DAILY OVERALL LIMITS

1.1 The maximum winnings categories listed below apply to bets placed on the Internet and in our Telephone Betting department.

1.2 The daily winning limits shall apply to a Customer or a group of customers deemed to be acting together, who have placed bets with the same selections.

1.3 A bet is accepted on the basis that it is the investment of one Customer only and the following are the maximum amounts that can be won by a Customer in one day’s betting regardless of stake and apply even if bets have been placed through more than one betting channel (i.e. internet, telephone betting and/or Playbet branches).

1.4 Where selections taken from the different contingencies and/or categories listed below are combined in multiple or accumulative bets the lowest maximum winning limit will apply.

1.5 In the event that win limits are exceeded due to but not limited to human error, computer malfunctioning and/or fraud, Playbet shall be entitled to amend betting transactions in question in order to bring the same within limit impositions.

1.6 By virtue of the limits indicated hereinunder the Customer undertakes and agrees not to transact the same transaction (so as to circumvent these limits) in another separate betting transaction (either in the Customer’s account or by utilizing the account of another person or by transacting a cash betting transaction).

1.7 Should the Customer breach this undertaking then the Customer acknowledges that Playbet will have the right, in its sole and unfettered discretion, to cancel the original and any other similar betting transaction to which the Customer is a party to/partner of. Playbet shall be entitled to exercise its right of cancellation before any of the sporting events indicated in the betting transaction having commenced and or during or after any of the sporting events the Customer will only be entitled to a refund of the amount staked, more particularly the Customer will not be entitled to claim any amount should the whole or part of the betting transaction have been successful or partially successful.

1.8 Playbet, in its sole and unfettered discretion, shall be entitled to impose a further win limit amount on specific Customers’ account.

1.9 Ante-post and early betting limits are solely at the discretion of Playbet management.

MAXIMUM WINNINGS 2. Tote/Open Bet

2.1 Open Bet Types 2.1.1. Win bets are won when the runner selected finishes first. 2.1.2. Place bets are won when the runner picked finishes in one of the up to four places. The number of places for which the bet is paid is determined by the Totalisator. Usually, there are three places being paid. However, depending on the country and number of runners, two or up to four places might be paid. All place bets are lost past the fourth place, even if the Totalisator pays further places.

2.2 Exacta bets are won when the two runners picked finish first and second in the exact order specified. Should one of the picked runners become a non-runner, the stakes shall be refunded. Should less than two runners cross the finishing line for a given race, all exacta bets shall be lost unless the Totalisator is providing exacta dividends.

2.3 Trifecta bets are won when the three runners picked finish first, second, and third in the exact order specified. Should one of the picked runners become a non-runner, the stakes shall be refunded. Should less than three runners cross the finishing line for a given race, the Totalisator rules shall apply for payout.

2.4 Quartet bets are won when the four runners picked finish first, second, third, and fourth in the exact order specified. Should one of the picked runners become a non-runner, the stakes shall be refunded. Should less than four runners cross the finishing line for a given race, the Totalisator rules shall apply for payout.

2.5 Swinger bets are won when the two runners picked finish in one of the top three places regardless of their order of arrival. Should one of the picked runners become a non-runner, the stakes shall be refunded. Should less than three horses cross the finishing line for a given race, all swinger bets shall be lost unless the Totalisator provides swinger dividends.

2.6 Double bets are won when the horses picked win both of the races that comprise the double.

2.7 Pick 3 bets are won when the horses picked win each of the three races that comprise the pick 3.

2.8 Jackpot bets are won when the horses picked win each of the four races that comprise the jackpot.

2.9 Place Accumulator bets are won when the horses picked finish in the top three places in each of the seven races that comprise the place accumulator.

2.10 Bipot bets are won when the horses picked win or run second in each of the six races that comprise the Bipot.

2.11 Pick 6 bets are won when the horses picked win each of the six races that comprise the pick 6.

3. OPEN BETS / TOTE LIMITS

The Customer acknowledges, agrees and confirms that:

3.1. All open bets offered by Playbet shall be subject to limits as determined by Playbet (see limit table below) 3.2. Limits will apply to each Customer’s betting transaction per type and per event. The payout limit will be the lesser of the pool size and he value of the stake applied at the odds limit, and always subject to the overall daily win limit. For example, if the total South African Totalisator pool on a particular Exacta pool is R2 500.00 then this will be the maximum payout that will be distributed to customers of Playbet who have selected the winning combination/s regardless of their stakes or the number of tickets. In this event, all winning combinations transacted with Playbet will be divided into the Total Pool and the resultant dividend will then apply i.e. if Playbet transacted 1 000 winning Exactas to a single or multiple customers and the South African Totalisator dividend was R3.50, Playbet would not pay R3 500.00 (R1 000 x 3,5) but would recalculate the dividend to pay the Pool Limit of R2 500.00; and

3.3. Successful open bet betting transactions shall be limited as regards South African Totalisator Win, Place, Swinger, Exacta, Trifecta, Quartet, Double, Place Accumulator, Jackpot, Bipot, Pick 3 and/ or Pick 6 dividends; and

3.4. The open bet payouts will be limited by the number of dividends being paid by the South African Totalisator i.e. the South African Totalisator pool will be divided by the number of open bet dividends declared for a specific horse race event. Therefore, if a horse race event is paying 4 places, the South African Totalisator place pool will be divided by 4 and that value shall be applied to each placing. For example, if the net swinger pool is R3000.00 (three thousand Rands) and there are 3 swingers to be paid, the net pool for each swinger will be R1000.00 (one thousand Rands) i.e. R3000.00/3 singers, and this shall be the open bet limit applied. Therefore, if a Customer transact successful swinger betting transactions and should the dividend declared result in a total payout of R1 300.00 (one thousand three hundred Rands) then this payout will be reduced to the limit of R1000.00 (one thousand Rands); and

3.5. Open Bets (Pick 6s, Jackpots, other tote exotics), no matter how many times indicated in the same betting transaction (for example should the Pick Six be transacted by the Customer 20 times) shall be limited to a maximum payout as set out on the table below i.e. even if the Pick Six dividend paid multiplied by 20 totals an amount exceeds the limit of R500 000.00 (Five Hundred Thousand Rand); and

3.6. By virtue of the limits indicated herein under the Customer undertakes and agrees not to transact the same betting transaction (so as to circumvent these limits) in another separate betting transaction (either in the Customer’s account or by utilizing the account of another person or by transacting a cash betting transaction).

3.7. The win limit indicated herein under will be further subject to the pool amount relative to the type of bet (i.e. if the pool amount is less than the win limit set out in the table below, your winnings shall be limited to the pool amount, and in the event that the pool amount is more than the win limit set out in the table below, your winnings shall be limited to the win limit set out in the table below , but always subject to the daily overall win limit.

3.8. Should the Customer breach this undertaking then the Customer acknowledges that Playbet will have the right, in its sole and unfettered discretion, to cancel the original and any other similar betting transactions to which the Customer is a party to/partner of.

3.9. Playbet shall be entitled to exercise its right of cancellation before any of the sporting events indicated in the betting transaction having commenced and or during or after any of the sporting events the Customer will only be entitled to a refund of the amount staked, more particularly the Customer will not be entitled to claim any amount should the whole or part of the betting transaction have been successful or partially successful; and

2.3 Upliftment of the self-exclusion
